Local, State and Federal Permits and Reviews
Local Permits:
1. Order of Conditions from the Fairhaven Conservation Commission
for the
construction of power connection to the distribution grid.
State Permits:
1. Order of Conditions under the Wetlands Protection Act under
M.G.L. Ch. 131, S. 40 (authority delegated to the Fairhaven Conservation
Commission) for the construction of power connection to the distribution
grid.
2. License from the DEP, Division of Waterways under M.G.L. Ch.
91.
3. Massachusetts Clean Waters Act: Section 401 Water Quality Certificate.
4. Massachusetts Energy Facility Siting Board, Certificate of
Environmental Impact and Public Need.
Federal Permits:
1. US Army Corps of Engineers Section 10/404 individual permit.
2. US Coast Guard permit to establish and operate a privets aid
– to – navigation to a fixed system.
State Reviews:
(Note: many state agencies will review the project through review
of the Environmental Impact Report; the following are agencies specifically
required review the project, independent of the EIR process)
1. Determination by the Executive Office of Environmental Affairs
(MEPA Unit) regarding the need for an Environmental Impact Report.
2. Certificate from the Executive Office of Environmental Affairs
that the Environmental Impact Report complies with the requirements
of the Massachusetts Environmental Policy Act and adequately describes
the impacts of the project.
3. Review of the project by the Massachusetts Natural Heritage
and Endangered Species Program.
4. Review of the project by the Massachusetts Historical Commission.
5. Massachusetts Aeronautics Commission review of all structures
over 200 feet tall.
6. Consistency review by the state Office of Coastal Zone Management
for compliance with state and federal policies including the Ocean
Sanctuaries Act.
7. Massachusetts Board of Underwater Archaeology review of project
details.
Federal Reviews:
(Note: many federal agencies will review the project through review
of the Environmental Impact Report; the following are agencies specifically
required to review the project, independent of the EIR process)
1. Review by the Federal Aviation Administration (FAA) for any
structure over 200 feet tall.
